Consumer Rights

GlamLuxe is committed to ensuring maximum transparency and respect for consumer rights, as established by the Consumer Code . By purchasing on www.glamluxe.it , you are entitled to:      

Receive clear and complete information before purchasing
All products on the Site are described with technical details, materials, price and indicative delivery times. There will be no hidden costs and shipping costs will be clearly indicated before payment.

Receive your products on time
The products will be shipped according to the times indicated during the purchase. In case of significant delay, you have the right to be informed and, if necessary, to request a refund.

Withdraw from your purchase within 14 days without having to provide any explanations
If you change your mind, you can exercise the right of withdrawal within 14 days of delivery and obtain a refund, according to the methods described in the dedicated section.

Get a refund or replacement in case of defective or non-compliant product
If the product received has defects of conformity (e.g. a product different from the one ordered or damaged), you are entitled to repair, replacement or refund, according to the 24-month Legal Guarantee.

Scope of Application

These General Conditions of Sale apply exclusively to purchases made by private consumers ( B2C , Business to Consumer ) and not to individuals who purchase the products for professional or commercial purposes ( B2B , Business to Business ). For professional customers, different conditions may apply, to be agreed with GlamLuxe on a case-by-case basis.

Changes to the Terms of Sale

The conditions contained in this document may be modified by GlamLuxe without prior notice and will be valid from the date of their publication on the website www.glamluxe.it, in compliance with the provisions of articles 49 and following of Legislative Decree 206/2005 (Consumer Code), which regulate pre-contractual information in distance contracts. Such changes will not have retroactive effect on orders already placed and confirmed before their publication.

To register and validate your personal account, without which you will not be able to make purchases on the GlamLuxe.it website , you will need to fill in the mandatory fields and provide a valid email address, also as a sign of your consent. We would like to point out that only email addresses relating to domains that cannot be traced back to temporary email addresses will be accepted for registration purposes. With reference to this latter type of email address, glamluxe.it therefore reserves the right to prevent registration on the Site. Likewise, glamluxe.it reserves this right in the event that it has evidence of the fact that the email addresses used have been created automatically (for example, through a bot), with the ultimate aim of preventing the sale of a given Product or with the objective of damaging glamluxe.it.

Prices

GlamLuxe guarantees full compliance with the Omnibus Directive, implemented in Italy by Legislative Decree 26/2023, which regulates the management of prices, promotions and discounts, offering its customers a clear and transparent purchasing experience. Each discount or promotion indicated on the site is accompanied by the lowest price applied in the last 30 days, as required by current legislation, to allow a correct assessment of the actual value of the discount. This policy reflects GlamLuxe's ​​commitment to protecting consumer rights and ensuring honest commercial practices, in line with the highest standards of transparency and fairness.

The prices of the products on the Site www.glamluxe.it include VAT at 22% and include any other additional costs, such as transport insurance, duties, taxes or additional costs, while they do not include transport costs , which will be calculated and specified separately at the time of checkout. GlamLuxe is committed to ensuring transparency and clarity in the prices indicated, so that the customer does not have to face unexpected costs at the time of purchase.

GlamLuxe reserves the right to change the prices indicated on the site at any time, without prior notice. Naturally, if you have already sent your Order, the price of the ordered Product cannot be changed and will correspond to that indicated in the Order Summary email. Despite our best efforts, GlamLuxe cannot exclude that, due to a mere material error, a different price than the actual one may be indicated for some products. The correctness of the prices is always checked during the Order verification and subsequent shipping process. If the indicated price is affected by a recognizable error, GlamLuxe reserves the right to cancel the Order, in accordance with art. 1431 of the Civil Code. In this case, the customer will be immediately informed and any amount already paid will be fully refunded. Unless the delivery of the Product is free, the transport costs will be indicated in the Order Summary email in a separate line, separate from the price of the Product

When you find a crossed out price

On GlamLuxe , a crossed out price indicates that the product benefits from a discount applied compared to the original list price .

1.      The crossed out price corresponds to the discounted price (-25%) , which is the price actually paid by the customer.

2.      The uncrossed out price shown next to it represents the initial list price , i.e. the value of the product before the discount is applied.

Practical example:

1.      If a product has a list price of €100 , the discounted price (-25%) will be €75 .

2.      The site will show €100 without a strikethrough (initial price) and €75 with a strikethrough (final discounted price)

Pricing Errors and Corrections

GlamLuxe is committed to ensuring maximum accuracy in the publication of prices, but cannot exclude the possibility of material errors. If a price indicated on the site is evidently incorrect (for example, a high-value product sold for a few euros or with a macroscopically excessive price), we ask you to promptly notify us before carrying out any operation. If you have already completed an order, to protect your and our interests, GlamLuxe reserves the right to cancel the order, in accordance with art. 1431 of the Civil Code. In this case, you will be promptly informed and any amount already paid will be fully refunded with the same payment method used.

Price Management and Information Transparency

GlamLuxe is committed to ensuring maximum transparency and correctness in the management of prices, promotions and commercial communications, in full compliance with current Italian and European regulations. Our pricing policy is structured to offer customers a clear, safe and unambiguous purchasing experience , ensuring that all information relating to costs is presented in a complete and easily understandable manner.

To this end, GlamLuxe adopts rigorous compliance standards in line with the following regulations:

    • Art. 6 – Clarity of information: all prices are indicated in a legible and comprehensible manner, inclusive of VAT and any mandatory costs , with no hidden costs.
    • Art. 49 and following – Pre-contractual obligations: GlamLuxe provides all information on price, shipping costs and payment methods before purchase , ensuring an informed choice.
    • Art. 51 – Mandatory information before purchase: before confirming the purchase, the Customer receives all the necessary information on the final price, additional costs and payment methods.
    • Art. 57 and 66-quinquies – Refund methods: in the event of a return or refund, the customer is clearly informed of the times and methods for returning the amount paid.
    • Art. 64-67 – Right of withdrawal: the Customer has the right to a full refund if he cancels the order before shipment or exercises the right of withdrawal within the terms provided.
    • Art. 23 and 26 – Unfair commercial practices: GlamLuxe undertakes not to adopt deceptive strategies such as artificial price increases before a reduction or misleading promotional communications.

·   Legislative Decree 70/2003 on Electronic Commerce

    • Art. 7 – Price transparency: all products on sale clearly show the total price , including any delivery costs and conditions for applying discounts.

·   EU Directive 2019/2161 ("Omnibus Directive")

    • GlamLuxe scrupulously applies the criteria established by the Omnibus Directive, which requires the indication, in the event of a discount, of the lowest price practiced in the previous 30 days , avoiding any form of false price reduction.

·   EU Regulation 2017/2394 on consumer protection

    • We ensure clear price comparability by adopting policies that prevent arbitrary variations or deceptive practices in determining discounts.

·   EU Regulation 1169/2011 on labelling and price transparency

    • Although this regulation was originally designed for the food sector, GlamLuxe applies the principle of clarity in the indication of prices , particularly in products sold by unit of measurement.

·   EU Regulation 2022/2065 (Digital Services Act)

    • As an e-commerce operator, GlamLuxe adheres to the obligations of transparency of commercial offers , providing detailed and updated information on prices and conditions of sale.

How to use the Purchase Voucher and Discount Coupon

The "Purchase Voucher" purchased from GlamLuxe or possibly issued in certain circumstances (for example during any promotional activities of GlamLuxe), will be usable by the expiry date possibly indicated on the Purchase Voucher itself. The Purchase Voucher can be used in a single solution and for a single Order. The Purchase Voucher, therefore, cannot be split: therefore, if the Purchase Voucher is only partially used, the remaining part will be unusable and nothing will be owed by GlamLuxe. The Purchase Voucher is not transferable to third parties, can only be used to purchase the Products marketed on the website www.glamluxe.it and cannot be converted into cash or used to purchase other Purchase Vouchers.

In the event of Orders for Products with a total value greater than that of the Purchase Voucher, it will be necessary for the person intending to proceed with the purchase to pay GlamLuxe the difference, for the purposes of correct completion and sending of the Order, by choosing a payment method from those available in the Procedure.

The right of withdrawal is not applicable to the purchase of Purchase Vouchers. The right of withdrawal is guaranteed to the recipient of the Purchase Voucher, only if the recipient has the necessary characteristics required by the applicable legislation. For further details, see the "Right of Withdrawal" section on this page. GlamLuxe is in no way responsible for any theft of a Purchase Voucher or for fraudulent use of the same. GlamLuxe is in no way responsible for any loss or misuse of the activation code relating to a Purchase Voucher. No refund, even partial, or replacement, will take place in the event of loss, careless storage, theft or failure to use, in whole or in part, within the expiry of the Purchase Voucher. Purchase Vouchers can be combined with all other discounts and promotions on the GlamLuxe website and, if more than one is received, with other Purchase Vouchers.

GlamLuxe reserves the right to cancel without notice Orders placed using Vouchers and/or discount coupons if improper, suspicious, anomalous or unauthorized use is detected. This includes, but is not limited to, violations of the conditions of use or attempted fraud.

Discount Coupon

The Discount Coupons offered by GlamLuxe are designed to offer exclusive benefits to customers and make every shopping experience more special. To ensure maximum flexibility, Discount Coupons generally have an initial validity of 1-2 weeks, but to safeguard the rights of our customers, GlamLuxe applies an automatic extension of the expiration dates in order to allow their extended use over time. Each Coupon is subject to specific validity criteria, designed to offer a transparent and hassle-free shopping experience.

Note on actual expiration:

The actual expiration of each Discount Coupon is set 24 hours after the expiration date specified in the coupon. This measure guarantees an additional margin to allow customers to use the Coupon in case of unforeseen events.

General Discount Coupon Rules:

·         Each Discount Coupon is valid for one Order only.

·         Discount Coupons cannot be combined with each other: only one Coupon can be used per Order.

·         During special promotions (e.g. Black Friday), any Discount Coupons will not be valid for technical reasons, but their validity will still be extended to ensure that they can be used on future orders.

·         Discount Coupons cannot be converted into cash or used to purchase Gift Cards.

·         The validity of the Discount Coupon is specified in the communication received. Once expired, and if an extension has not already been applied, the Coupon cannot be reactivated or replaced.

Procedure to follow:

1.      You will receive a link via email or SMS.

2.      By clicking on the link, you will be redirected to the website www.glamluxe.it with the discount already applied to the cart.

3.      Any problems in applying the Coupon can be resolved by contacting customer support.

Processing of personal data: GlamLuxe processes personal data in accordance with EU Regulation 2016/679 (GDPR). The data provided for the use of Discount Coupons will be processed exclusively for promotional and contractual purposes, in compliance with Article 6(1)(b). Payments

GlamLuxe guarantees its customers a safe, clear and reliable shopping experience, offering transparent payment methods that comply with consumer protection standards. Each transaction is managed with maximum security and data protection , ensuring that the payment process is simple, intuitive and free of surprises . Payment and Order Confirmation

In particular, your sales contract with GlamLuxe must be considered perfected at the following times, depending on the payment method you have chosen, among those available, during the Order Issuance Procedure:

·         Credit/debit card or prepaid credit card : the contract is concluded when you send the order and the relevant banking institution authorises the sole commitment of the amount relating to the Product which is the object of the Order (the so-called ceiling block) for an amount equal to the price of the Products which are the object of the Order.

·         Paypal : the contract is concluded when you send the order and the amount is actually charged, which will vary depending on the option available and selected by you (payment in a single solution or "pay in 3 installments").

·         Bank Transfer: the contract must be considered concluded when, after clicking on "Confirm purchase", you are directed to the Thank You Page, but its effectiveness is subject to the suspensive condition of the actual crediting of the price of all the Products covered by the Order to the GlamLuxe current account within 5 (five) days from the conclusion of the sales contract , it being understood that, if this deadline is not respected, the sales contract will not produce any effect.

·         Purchase by financing : in the event that, during the Order Issuance Procedure, you select the “Financing” payment method, the contract must be considered concluded when the finance company sends you the pre-authorization of the financing contract, but its effectiveness is subject to the suspensive condition of receipt by GlamLuxe, within 15 (fifteen) days of the conclusion of the sales contract, of the communication with which it is informed of the completion of the financing contract between you and the finance company, it being understood that, if this deadline is not respected, the sales contract will not produce any effect, without any liability arising from this on the part of GlamLuxe.

·         The order is considered accepted and will follow its process in the presence of these conditions:

·         Credit/Debit Card: The amount is authorized by the banking institution.

·         PayPal: The amount is charged.

·         Bank transfer: The order is completed upon receipt of the credit within 5 days.

·         Financing: The order is finalized upon receipt of confirmation from the finance company.

Shortly after you are directed to the "Thank You Page", GlamLuxe will automatically send the Order summary message ("Order Summary") to your email address. The Order Summary will report the date of receipt of the Order, the "Order Number" and the "Customer Code", which we will ask you to use in any further and subsequent communications with GlamLuxe. The Order Summary message reports the data you entered in the Order Issuance Procedure: we ask you to verify their accuracy and promptly notify us of any errors and corrections to be made, following the instructions in the message. Remember that you can check the status of your Order at any time by accessing your Personal Area and selecting the "Order Status" item.

Following the Order Summary email, GlamLuxe will send you a subsequent and separate email containing information relating to the shipment of the ordered Product and the relative tracking ("Shipment Confirmation"). In the event that the Order is fulfilled through multiple shipments, you may receive multiple Shipment Confirmations via separate emails. Should there be any problems with the processing of your Order by us, GlamLuxe itself undertakes to send you appropriate communication in the shortest technical time possible.
Without prejudice to any other remedies provided by law, if GlamLuxe is unable to process the Order, for any reason whatsoever, the payment authorization will be cancelled (i.e., GlamLuxe will carry out, within the technical timeframes permitted by the credit/banking institutions and/or the payment system manager, the so-called unblocking of the credit limit) or, if applicable, the full refund of the price of the specific Product possibly already paid by you at the time of sending the Order, according to the payment method chosen or, where the refund cannot be made for technical reasons using the payment method chosen and at the request of GlamLuxe, by bank transfer to the current account indicated by you.

Please note that the times for the visibility of the refund may vary based on the payment method you used. In fact, you may not immediately see the release of the limit or the refund of the price if you used, for example, a credit card, financial card or Paypal as a payment method; the times for the visibility of the refund and/or any delays in the refund do not depend, in fact, on GlamLuxe, but on the credit/banking institution and/or the payment system manager.
In the case of particular promotions carried out by GlamLuxe, the conditions and limits established from time to time for that specific promotion will apply.
Without prejudice to the right of withdrawal in compliance with the terms and conditions set out in the following section Right of Withdrawal of these General Conditions, you may cancel the Order before the Order is being prepared in the warehouse and no later than 24 hours after payment. In this case, you will not be charged any price and/or cost.
If you are a consumer (i.e. a natural person who purchases the goods for purposes not related to his/her professional activity), we invite you to print or save an electronic copy and, in any case, keep these General Conditions, the Order and any further communication between you and GlamLuxe and relating to the Order, in compliance with the provisions of articles 3 and 4 of Legislative Decree no. 185/1999 and art. 51 of Legislative Decree 6 September 2005, no. 206, containing the Consumer Code, on distance selling.

Payment Methods

GlamLuxe offers different payment methods to ensure maximum flexibility and security in transactions. All payments are processed through secure connections (SSL) and in compliance with the PSD2 Directive on Strong Customer Authentication ( SCA ), which introduces an advanced level of protection for online payments.

GlamLuxe does not directly manage payment data or decisions to approve or reject transactions made by credit card, PayPal, bank transfer or financing. The processing and acceptance of payment are managed exclusively by the respective banking institutions, payment companies or financial institutions, which are responsible for managing sensitive data and complying with privacy regulations, including compliance with the General Data Protection Regulation (GDPR) – EU Regulation 2016/679 .

GlamLuxe Payments Limitations of Liability

GlamLuxe is not responsible for:

1.      Decisions made by credit institutions or finance companies regarding the acceptance or refusal of payment.

2.      Delays in crediting or reversing funds by banking or payment institutions.

3.      Privacy issues related to third-party payment processing (banks, PayPal, Klarna, etc.).

For any issues relating to payment refusals, denied authorizations, delays in processing transactions or the management of privacy and security of payment data, the Customer must contact their credit institution, the payment platform used or the financial company involved directly.

At the time of purchase, the Customer can choose between the following payment methods:

Below we summarise the specific provisions that regulate the payment methods available to you, pointing out to you from now that some of the payment methods described below may not be available for reasons beyond the intentions of GlamLuxe.

Bank transfer

If you trust in the honesty of GlamLuxe and choose this payment method, you will have to make an advance payment by bank transfer to the bank details that will be indicated in the Order Summary email. In the reason for the bank transfer you will have to include the alphanumeric identification code of the Order that will be communicated to you in the same.

GlamLuxe will process the Order as soon as the sales contract between you and GlamLuxe becomes effective, i.e. when the full price of the Order is actually credited to GlamLuxe's ​​current account, which must in any case occur within 5 (five) days from the Order Summary date, after which the Order, in the absence of the aforementioned credit to GlamLuxe's ​​current account, will automatically lose all validity and effectiveness. GlamLuxe undertakes, for the aforementioned term of 5 (five) days and for the following days (necessary for the conclusion of the currency transfer procedures) to keep the price of the Product which is the object of the Order blocked. Once the aforementioned term of 5 (five) days has expired without the full price of the Order being actually credited to GlamLuxe's ​​current account, GlamLuxe will send you a specific communication informing you of the cancellation of the Order (and the consequent termination of the validity of the sales contract between you and GlamLuxe). Should you change your mind and subsequently remain interested in purchasing, simply let us know by writing to the email address ordini@glamluxe.it which will take care of the matter.

Credit card

If you choose this payment method, the relevant banking institution will authorize only the commitment of the amount relating to the Product that is the subject of the Order (the so-called ceiling block). The amount of the Order will be charged to your credit card at the time of issuing the Shipment Processing Confirmation. For the sake of clarity, we would like to point out that if the Order relates to multiple Products, for technical reasons the entire amount of the Order will be charged at the same time as the first Shipment Processing Confirmation is issued, even if such Shipment Processing Confirmation relates to only one of the Products that are the subject of the Order. In all cases in which the security systems of the financial institution and/or the anti-fraud systems available to GlamLuxe do not detect that the security requirements are met and/or detect an inconsistency or an anomaly, the transaction will be rejected and the sales contract between you and GlamLuxe will be considered terminated for reasons not attributable to GlamLuxe

In the event that you decide to cancel the Order to the extent permitted by law or the General Conditions, or GlamLuxe, due to exceptional circumstances beyond its control, cannot follow up on your Order, GlamLuxe itself will request the credit card circuit to cancel the transaction and release the amount committed. The release times for the amount committed depend exclusively on the banking system.

We remind you that, with the exception of the so-called “Masked PAN” (“Masked Pan” is an anti-fraud security measure consisting of the truncation of the primary account number. When you pay for a Product with your credit or debit card, the card numbers are truncated by the system with the missing digits replaced by “wildcard” characters such as asterisks) at no time during the Procedure is GlamLuxe able to know the information relating to your credit card, as the same is entered by you directly on the website of the banking institution that manages the transaction (with extremely high security systems); therefore, as there is no data transmission, there is no possibility that this data can be intercepted, known or knowable by GlamLuxe. Prepaid Cards

If you choose this payment method, the relevant banking institution will authorize only the commitment of the amount relating to the Product that is the subject of the Order (the so-called ceiling block). The amount of the Order will be charged to your credit card at the time of issuing the Shipment Processing Confirmation. For the sake of clarity, we would like to point out that if the Order relates to multiple Products, for technical reasons the entire amount of the Order will be charged at the same time as the first Shipment Processing Confirmation is issued, even if such Shipment Processing Confirmation relates to only one of the Products that are the subject of the Order.

In case you decide to cancel the Order to the extent permitted by law or the General Conditions, or if GlamLuxe, due to exceptional circumstances beyond its control, cannot follow up on your Order, GlamLuxe itself will request the credit card circuit to cancel the transaction and release the amount committed. The release times for the amount committed depend exclusively on the banking system you use.

We remind you that, with the exception of the Masked PAN (as defined above), at no time during the Procedure is GlamLuxe able to know the information relating to your credit card, as the same is entered directly on the website of the banking institution that manages the transaction (with very high security systems); therefore, as there is no transmission of data, there is no possibility that this data is intercepted, known or knowable by GlamLuxe. PayPal

If you choose this payment method, you will be directed during the Order Issuance Procedure to the PayPal login page to correctly complete the Order. Paypal allows you to choose between these two methods:

·         "Pay in 3 installments" (available only to individuals residing in Italy and on eligible purchases from €30.00 to €2,000.00), in which the amount will be charged to you in three separate installments, the first upon receipt of the Order Summary email and the other two at 30-day intervals;

·         Standard payment , in a single solution, in which the charge will be requested upon receipt of the Order Summary email.

In the event that you decide to cancel the Order to the extent permitted by law or the General Conditions, or GlamLuxe, due to exceptional circumstances beyond its control, cannot proceed with your Order, the amount charged will be refunded to your PayPal account.

We remind you that at no time during the Procedure GlamLuxe is able to know the information of your PayPal account; therefore, since there is no transmission of data, there is no possibility that this data can be intercepted, known or knowable by GlamLuxe. Therefore, no computer archive of GlamLuxe contains or stores such data. For each payment or commitment made with the PayPal account, you will receive a confirmation email from PayPal and not from GlamLuxe. If you choose this payment method, to continue you will have to accept the terms and conditions of PayPal.

Installment Financing with Klarna

This form of payment by installments can be used (i) only by customers considered by the applicable legislation as “consumers” (i.e. natural persons who purchase the goods for purposes not related to their professional activity) and holders of a bank or postal current account, and (ii) only for amounts between 499.00 Euro and 5,200.00 Euro.

If you intend to apply for financing, you will have to select the payment method “Pay with Klarna” in the Order Issuance Procedure. You can choose between three different payment methods offered by Klarna Bank AB:

·         Payment by installments: In three monthly installments without interest

·         Pay Later: Up to 30 days to complete your payment without interest

·         Pay Now: Direct payment without interest or fees

During the Order Issuance Procedure, you will then be directed to the Klarna Bank AB website, where you will be asked to complete the online financing application form by entering some of your personal data, such as, but not limited to, your profession, the composition of your family unit, your income.

You will need to follow all the instructions on the Klarna Bank AB website to correctly forward the documentation to the latter. Upon completion of this procedure, you will receive updates on the non-binding financing request from Klarna Bank AB via email. Once all the documentation has been received and assessed, Klarna Bank AB will be able to issue final approval by sending a confirmation email; in this case, the sales contract between you and GlamLuxe will become effective and GlamLuxe will take charge of the Order and process it for the purposes of subsequent fulfillment of the shipment of the Product. We remind you that Klarna Bank AB will be able to decide in full autonomy whether or not to approve your financing request.

In the event that GlamLuxe does not receive the communication regarding the completion of the financing contract between you and the financial company within 15 (fifteen) days from the Order Summary email, the sales contract between you and GlamLuxe in relation to which you requested the financing from Klarna Bank AB. will automatically lose all its validity and, in this sense, GlamLuxe will send you a specific communication with which it will inform you of the cancellation of the Order. GlamLuxe is not responsible for any damages, costs, expenses and/or losses of any kind suffered by you and resulting from the non-approval of the financing.

It is understood that if GlamLuxe is unable to process your Order with reference to one or more Products of those covered by the Order and, therefore, the amount of the Order falls below the threshold amount financeable by Klarna Bank AB (i.e. 499.00 Euro), GlamLuxe will request payment of the amount below the threshold using the methods and means available on the Site, without prejudice to the right of withdrawal pursuant to the Right of Withdrawal Section below.

For pre-contractual information, please refer to the document "Standard European Consumer Credit Information" (SECCI) which you will find on the dedicated Klarna web page together with a copy of the contractual text, when uploading the non-binding financing request.

In the list above you will find the various payment options you can choose from. For information on conditions and procedures, we recommend that you contact the company that issues the title or your bank directly.

Moment of completion of the contract

The sales contract is considered to be perfected at the following times, depending on the payment method chosen:

·         Credit/Debit Card or Prepaid Card: The contract is finalized when the order is sent and the reference banking institution authorizes only the commitment of the amount relating to the purchased Product (blocking of the credit limit). The actual charge occurs at the time of shipment.

·         PayPal: The contract is concluded when the order is sent and PayPal immediately debits the amount, in a single solution or via the “Pay in 3 installments” option (if available and selected by the user).

·         Bank Transfer: The contract is considered concluded when the user places the order, but its effectiveness is subject to the receipt of the actual credit on the GlamLuxe current account within 5 days. After this period without credit, the order is automatically cancelled.

·         Financing via Klarna: The contract is considered concluded upon pre-authorization by the finance company, but its effectiveness is subject to the final confirmation of the financing within 15 days. In the event of non-approval, the order will have no effect.

Order Creation Procedure

You will be able to select and add to your cart the Products present in the electronic catalogue of glamluxe.it at the time of creating the Order and visible at the address www.glamluxe.it, as described in the relevant information sheets.
GlamLuxe points out that the images on its website are merely indicative and may sometimes differ from reality. We invite you to read the sheets carefully in the event of issuing the Order, paying particular attention to the characteristics of the goods, to any optional accessories, evaluating their relevance and essentiality for the purposes of choosing the product.

During the Order Issuance Procedure, you will be asked to indicate, by clicking on the appropriate boxes, your choice among the options made available with reference to certain aspects of the Order (for example, available variants, payment method, shipping address, etc.). After indicating your choices, you will find the “Confirm purchase” button, which you must click to send your order (“Order”) to GlamLuxe.

When you are directed to the confirmation page for the correct completion of the Order (“Thank You Page”), the Order Issuance Procedure shall be considered completed.
Your Order is considered for all legal purposes as an acceptance of the offer made by GlamLuxe for the Products included in the Order, each considered individually.

Important note: To proceed with the creation of the order, you must first complete the registration of a personal account on the website www.glamluxe.it .

Regulatory References on Orders

The purchase of products on www.glamluxe.it constitutes a distance selling contract governed by the Consumer Code (Legislative Decree 206/2005, art. 45 et seq.) and by the Civil Code regarding sales contracts. By placing an order on the Site, it will mean that you are fully accepting the General Conditions of Sale , committing to respect them. The contract is considered perfected when GlamLuxe confirms the order by email. The order placed by you as the Customer will represent a binding offer to purchase. GlamLuxe reserves the right to accept or refuse an order at its own discretion, without anyone being able to make any claim for compensation in the event of non-acceptance.

Request for Quotation for Large Volume Orders

If you wish to purchase at least 4 pieces of the same product or at least 8 pieces of different products, you can send a Custom Quotation Request to the email address ordini@glamluxe.it . GlamLuxe will respond with an offer consistent with the request, valid for a limited period of time specified in the reply email. If the quotation you receive is to your liking, you can complete the order directly from the link received. If the quotation expires without receiving confirmation and you change your mind later, you will have to send a new request. In the event of stock shortage, GlamLuxe may propose alternative products or refuse the quotation.

Order Confirmation

Shortly after clicking the purchase confirmation button, you will be directed to the "Thank You Page", where GlamLuxe will automatically send you the Order summary message ("Order Summary") to the email address used to register on the Site. The Order Summary will report the date of receipt of the Order, the "Order Number" and the "Customer Code", which we will ask you to use in any further and subsequent communications with GlamLuxe. The Order Summary message reports the data entered in the Order Issuance Procedure: we ask you to verify their accuracy and to correct them on the Customer Account but also to promptly notify us of any errors and corrections to be made, following the instructions in the message. Remember that it will be possible to check the status of the Order at any time by accessing the Personal Area and selecting the "Order Status" item.

Following the Order Summary email, GlamLuxe will send you a subsequent and separate email containing information relating to the shipment of the ordered Product and the relative tracking ("Shipment Confirmation"). In the event that the Order is fulfilled through multiple shipments, you may receive multiple Shipment Confirmations via separate emails. Should there be any problems with the processing of your Order by us, GlamLuxe itself undertakes to send you appropriate communication in the shortest technical time possible.
Without prejudice to any other remedies provided by law, if GlamLuxe is unable to process the Order, for any reason whatsoever, the payment authorization will be cancelled (i.e., GlamLuxe will carry out, within the technical timeframes permitted by the credit/banking institutions and/or the payment system manager, the so-called unblocking of the credit limit) or, if applicable, the full refund of the price of the specific Product possibly already paid by you at the time of sending the Order, according to the payment method chosen or, where the refund cannot be made for technical reasons using the payment method chosen and at the request of GlamLuxe, by bank transfer to the current account indicated by you.

Please note that the times for the visibility of the refund may vary based on the payment method you used. In fact, you may not immediately see the release of the limit or the refund of the price if you used, for example, a credit card, financial card or Paypal as a payment method; the times for the visibility of the refund and/or any delays in the refund do not depend, in fact, on GlamLuxe, but on the credit/banking institution and/or the payment system manager.
In the case of particular promotions carried out by GlamLuxe, the conditions and limits established from time to time for that specific promotion will apply.
Without prejudice to the right of withdrawal in compliance with the terms and conditions set out in the following section Right of Withdrawal of these General Conditions, you may cancel the Order before the Order is being prepared in the warehouse and no later than 24 hours after payment. In this case, you will not be charged any price and/or cost.
If you are a consumer (i.e. a natural person who purchases the goods for purposes not related to his/her professional activity), we invite you to print or save an electronic copy and, in any case, keep these General Conditions, the Order and any further communication between you and GlamLuxe and relating to the Order, in compliance with the provisions of articles 3 and 4 of Legislative Decree no. 185/1999 and art. 51 of Legislative Decree 6 September 2005, no. 206, containing the Consumer Code, on distance selling.

Modifying and Cancelling Orders

Orders cannot be changed once confirmed. In case of error, you will have to exercise your right of withdrawal after receiving the product. You will be able to cancel an order within 24 hours of payment, provided that the product has not already been shipped. In this case, the full amount will be refunded. If the order is refused or canceled by GlamLuxe for internal reasons, you will be informed and will receive a full refund, according to the payment method used.

Waiver of Purchase

If, at the time of delivery, you decide not to accept the Product, you have the right to refuse it without having to provide a specific reason. However, it is important to distinguish the refusal to purchase from the right of withdrawal, which is regulated separately in the next section and provides specific conditions for returns and refunds.

Difference between waiver of purchase and right of withdrawal

  • Purchase waiver: occurs when the customer refuses delivery without ever taking possession of the product. In this case, the package is automatically returned to the sender without the need for a further return procedure.
  • Right of withdrawal: applies after the customer has accepted delivery and taken possession of the product . In this case, the customer must follow the return procedure indicated in the dedicated section of this page.

Procedure for exercising the right to renounce the purchase

To correctly exercise the right to waive the purchase, the customer must follow the instructions below:

  1. Do not accept the package upon delivery : the customer must inform the courier that he/she is refusing delivery and not sign any collection receipt.
  2. Allow the package to be returned to sender : once delivery is refused, the courier will automatically return the package to GlamLuxe.
  3. Notify GlamLuxe of your refusal of delivery : we recommend that you send a notification by email or through the contact form, specifying your order number to facilitate the management of the matter.

Cases in which the cancellation of the purchase does not give the right to a refund

Refunds may not be granted in the following cases:

  • The customer accepts the delivery and then attempts to exercise the right to renounce the purchase (in this case the right of withdrawal and the related return conditions apply);
  • The package is refused after being opened or tampered with ;
  • The package is refused following a failed delivery attempt due to repeated absence of the recipient.

Refund Conditions

Once the refused package is received, GlamLuxe will process the refund according to the following conditions:

  • Refund will be issued within 14 days of receiving the refused package .
  • Initial shipping costs will not be refunded , except in cases where the cancellation is due to an error attributable to GlamLuxe (e.g. incorrect or damaged product during shipping).
  • The refund will be credited to the same payment method used for the purchase , unless otherwise provided in the Terms and Conditions of Service .

Specific Refund Details

In the event that payment has been made in advance by credit/debit card, PayPal or other digital payment systems, or advance bank transfer, GlamLuxe will proceed with the issue of the credit note and the relative refund. However, the costs of returning the product to the sender will be deducted from the refunded amount, as refusal to deliver generates an additional transport cost for redelivery to the warehouse. For example, if a product has been purchased for a value of €100, with shipping of €10, and the customer refuses delivery, the refunded amount will be €90, net of return costs.

In practice, the original shipping cost will be refunded, but the cost of returning the package will be deducted from the total amount.

In case of cancellation of the purchase, it will not be possible to convert the order into a voucher, change the destination or conditions of the order, or obtain a full refund, since the return shipping costs remain the responsibility of the customer. If you change your mind and still wish to receive the product at a later time, it will be necessary to place a new order according to the normal purchasing methods.

Regulatory References on the Purchase Waiver

These conditions relating to the waiver of purchase are governed by the following regulations:

Consumer Code (Legislative Decree 206/2005, updated)

  • Art. 132 Consumer obligations and acceptance of delivery : the consumer is required to take delivery of the purchased goods.

Civil Code

  • Art. 1510 cc, paragraph 2 – Delivery obligations and responsibilities: in sales with transport, the risk of loss or damage passes to the buyer upon delivery to the carrier, unless otherwise agreed.
  • Art. 1460 cc – Execution of contracts with reciprocal performance: if the customer refuses delivery without a valid reason, the seller may retain the payment received or request reimbursement of the expenses incurred.

Legislative Decree 70/2003 (E-commerce Regulation)

  • Art. 12 – Obligation to clarify delivery conditions and transport costs: the seller is required to inform the consumer about the shipping conditions and the responsibility in the event of non-acceptance.

Right of Withdrawal

In compliance with the legislation in force regarding distance selling, regulated by the Consumer Code (Legislative Decree 206/2005, updated  from Legislative Decree 21/2014) , which protects consumers in online purchases, the consumer has the right to withdraw from the purchase with the possibility of returning the purchased goods and obtaining a refund of the amount paid, except for the return costs which will be entirely at your expense.

Pursuant to Article 52, paragraph 2, letter b of the Consumer Code , the seller is required to recognize the consumer the term of 14 days to exercise the right of withdrawal , calculated from the date of delivery of the last item in the case of split shipments. Any refund will be made within 14 days of receipt of the return and will follow the procedures set out in the section dedicated to withdrawal, in compliance with the conditions of integrity of the product and any exclusions provided for by current legislation.

Right of Withdrawal on Partial Deliveries of a Multiple Order

In the event that an order is composed of multiple products and the delivery occurs in separate shipments, the term for exercising the right of withdrawal starts from the date of receipt of the last item of the order. The Customer has the right to exercise the right of withdrawal partially, returning only some products of the multiple order, without the obligation to return the entire purchase. In this case, the refund will be calculated based on the products actually returned and will include, if applicable, the initial shipping costs in proportion to the value of the returned goods.

To exercise these rights correctly and in compliance with the law, the consumer must comply with the conditions and methods specified in the following sections, in line with the current regulatory provisions. If you are a consumer (i.e. a natural person acting for purposes other than professional activity) you have the right to withdraw from the purchase contract concluded with GlamLuxe without having to provide any reason and without having to bear costs other than those specified in the following paragraph. The conditions and procedure for exercising this right are specified in the following paragraphs:

To exercise the right of withdrawal referred to in the previous paragraph, you can use the specific form that you will find attached in the dedicated section in your Personal Area. You will have to fill it in completely and choose whether to send it:

  1. By registered mail with return receipt (A/R) to the address Via C. Beccaria 5, 20149 Milan
  2. By PEC email to glamluxe@legalmail.it
  3. Via an address standard email to info@glamluxe.it .

In any case, you may communicate in writing, within 14 (fourteen) days from delivery of the Product or from the day on which you or a third party designated by you has acquired physical possession of the Product, your intention to exercise the right of withdrawal also, or in any case by presenting GlamLuxe with an explicit written declaration of your decision to withdraw from the contract. GlamLuxe Customer Care will take charge of the request and open the case in your Personal Area. Upon receipt of your withdrawal communication, GlamLuxe will send you a first confirmation email (to the email address used by the Consumer to register on the site) of receipt of the communication and, having verified that there are no impediments, a second email with the return form (RMA form) attached, with an authorization number, which you must attach to the outside of the package relating to the Product to be returned. To complete the withdrawal procedure, you will have to contact a courier of your choice and the shipping costs for returning the Product to GlamLuxe will be at your expense. Once the procedure specified above has been completed, you will have to send the Product, carefully packaged in the original manufacturer's packaging. On the outside of the box you will have to affix the RMA form and send the product via the indicated Courier, to the address specified in the authorized return procedure. All personal data, accounts, and any passwords entered by you must be absolutely removed. The Product must in any case be sent back to GlamLuxe which will indicate the correct address where to send the goods in the email communication with which the RMA code is sent. The shipment of the goods to be returned must take place within 14 (fourteen) days from the date on which you communicated to GlamLuxe your decision to withdraw.

Limitations and Exclusions of the Right of Withdrawal

Pursuant to art. 59 of the Consumer Code (Legislative Decree 206/2005, updated updated  from Legislative Decree 21/2014) , the right of withdrawal does not apply in the following cases:

1.       Sealed products which cannot be returned for hygiene or health protection reasons and which have been opened after delivery (art. 59 letter e).

2.       Electronic devices that are turned on, activated or connected to a personal account, as they are no longer resellable as new. This exclusion is attributable to the general principle of the decrease in value of the product due to use other than that necessary to verify the nature, characteristics and functioning of the good (art. 57, paragraph 2).

3.       Products sold in indivisible sets or bundles, which must be returned complete with all elements. Also in this case, the partial use of a product within a set entails a loss of value, falling within the application of art. 57, paragraph 2.

4.       Products with removed or damaged security seals, as their alteration precludes resale as new, also falling within the principle of diminished value (art. 57, paragraph 2).

Note: If the customer intends to return a product due to a lack of accessories or manuals, this lack must have been reported to Customer Service within 14 days of receipt, as required by art. 132 of the Consumer Code. Otherwise, the return will be refused and the refund will not be granted.

Regarding the condition of the goods, they must be in a normal state of conservation and you are only liable for the decrease in value resulting from handling other than "normal" and necessary to verify the nature, characteristics and functioning of the goods; The purchased Product must be returned in its original packaging, complete with all accessories and documentation, including the User Manuals. The Product must be returned in perfect condition and with all its accessories, also in perfect condition, Products that show signs of damage, wear or dirt will not be accepted; The returned Product must have the same serial number as on the invoice (if present); otherwise, if the serial number is different, the withdrawal will not be accepted and the Product will be made available to you again, without any financial reimbursement from GlamLuxe to you. The return shipment of the Product is under your responsibility and GlamLuxe will have no responsibility in case of loss or theft, therefore we recommend that you use a traceable shipping service to avoid risks of any kind.

For promotional offers that involve the purchase of various Products in combination with each other (bundled purchases), you may exercise the right of withdrawal only on the entire batch purchased, i.e. by returning all the Products purchased in combination.

Refunds

GlamLuxe reserves the right to withhold the refund until it has received the Products subject to the right of withdrawal.

1. Refund of Unfunded Orders

Once the goods subject to the refund have been received, GlamLuxe will refund the entire amount paid by you, within 14 (fourteen) days from the date on which you exercised the right of withdrawal if the returned goods were received within these terms, otherwise within 48 working hours following receipt, with the same payment method chosen by you during the Order Issuance Procedure or by bank transfer.

2. Refund of Financed Orders

Refunds with order placed with financing containing one or more Products with total return

If you exercise the total withdrawal, the financing procedure will be cancelled, always and only following the receipt of the goods for which the withdrawal has been requested. The cancellation of the financing procedure will be requested by GlamLuxe to Klarna Bank AB within 14 days from the moment in which you communicated your intention to exercise the right of withdrawal, if the receipt of the goods by GlamLuxe occurred within this period, otherwise within 48 working days following receipt of the goods. In the event that Klarna Bank AB has already charged the first instalment, Klarna Bank AB will refund it within the following 30 days. This procedure is intended

Refunds for orders placed with financing containing multiple Products with partial return

If you exercise partial withdrawal, or intend to exercise the right of withdrawal limited to one or some of the products included in the order, GlamLuxe, after receiving the partial refund, will communicate to Klarna Bank AB the new amount to be financed, corresponding to the price of the product(s) not subject to withdrawal. Klarna Bank AB will contact you to initiate the opening of a new financing procedure for the new amount communicated by GlamLuxe. In the event that the new amount is lower than the minimum financeable amount, it will not be possible to request financing for the new amount; therefore, you will have to contact customer service in order to agree on the total cancellation of the financing procedure and the payment of the Product(s) not subject to withdrawal.

To this end it is necessary that:

·         You communicate to GlamLuxe your intention to withdraw by indicating the product you intend to return as described above;

·         GlamLuxe assigns a Return Merchandise Authorization (RMA) Number;

·         You will be contacted by Klarna Bank AB or you can contact the finance company at 6994.4080 (Klarna Bank AB) and ask to open a new financing procedure with the new amount communicated by GlamLuxe;

·         The new financing agreement must show the new amount and be signed again by you according to the instructions provided to you by Klarna Bank AB;

·         That you have returned the product subject to withdrawal within the terms and with the methods described above.

Once we have received your communication, regarding your desire to exercise the right of withdrawal, GlamLuxe will proceed, within 14 (fourteen) days, to request the finance company to open a refund procedure for the old financing procedure and to recharge a new procedure with the new amount to be financed. The refund of the old financing procedure can only take place after the new financing contract has been regularly signed by you. The right of withdrawal can be exercised only and exclusively with regard to the entire Product; it is not possible to exercise the withdrawal on only a part of the purchased product (for example accessories, attached software, etc. ...);

3. Refunds for multiple orders with separate deliveries

In the case of orders containing multiple Products shipped separately, the refund will be managed according to the following methods, differentiated for non-financed and financed orders.

Refunds for Non-Funded Orders with Separate Deliveries

For non-funded orders, the refund will be processed independently for each return, with the following methods:

  • If an order includes multiple Products shipped separately and the Customer exercises the right of withdrawal on one or more of them, each return will be managed independently , with a separate refund for each product, following verification of the conditions of the return.
  • The refund will be issued within 14 (fourteen) days from the date of exercising the right of withdrawal, provided that GlamLuxe has received the Product subject to the refund within this period. If receipt occurs later, the refund will be processed within 48 working hours following receipt of the Product .
  • The refund will be credited to the same payment method used by the Customer during the purchase.
  • Initial shipping costs will not be refunded, except in cases where the return is due to an error by GlamLuxe (wrong, defective or damaged product upon delivery).

Refund of Financed Orders with Separate Deliveries

Orders placed with financing (via Klarna Bank AB or PayPal "Pay in 3 installments") are subject to specific refund procedures, determined by the financial institution involved.

  • Note: To manage the refund of financed orders containing multiple Products, please refer to the "Refunding Financed Orders" section of this document.

  • If a financed order contains multiple Products shipped separately and the Customer exercises the right of withdrawal on one or more of them, the refund will be processed based on the date of receipt of each return .

  • If products returned at different times change the total amount financed, the payment plan may be updated multiple times to accommodate the new amounts, which may result in a new financing agreement being issued.

  • Refund times will be calculated separately for each return , based on the date GlamLuxe receives the product and the subsequent processing of the request by the financial institution.

In all cases, the right of withdrawal and the consequent refund procedure apply exclusively to Products purchased in their entirety and cannot be exercised on individual parts of a Product (e.g. accessories, attached software, components).

For refund issues relating to delivery, such as lost packages or disputes regarding receipt, please refer to the Shipping section under the heading “Delivery Responsibility and Dispute Management” below.

Shipping

For each Order shipped, GlamLuxe issues a sales note (equivalent to a receipt) or invoice for the shipped Product. For the issuance of the tax document, the information provided by you during the Order Issuance Procedure is valid. Once issued, this tax document can no longer be modified. The Product travels with packaging made directly by the manufacturer, in cardboard boxes wrapped in transparent cellophane or security tape or in shipping envelopes with self-adhesive closure, depending on the warehouse of origin. GlamLuxe is fully committed to guaranteeing you a timely delivery of the Product.

Circumstances that can create delays in international shipments and lengthen the times for customs procedures in the EU compared to the past.

Estimated delivery times may vary between 9 and 30 business days , depending on your geographic location, logistical difficulties in transportation, customs clearance, and product availability. However, we are committed to making your wait a smooth journey, keeping you updated at every stage with shipment tracking. We kindly ask you to consider these factors when purchasing and to be patient as we work to minimize inconvenience and ensure your satisfaction.

The information sheets for each Product on the Site will contain an indicative estimate of the delivery period for the specific Product, consisting of a date range calculated on the basis of the delivery information statistics held by GlamLuxe and the information provided by you during the Order Issuance Procedure.

Any further delay caused by the obstacles set out above will be quantifiable and controllable through your Personal account in the “Track Your Product” section. Another variable that could affect delivery times could be payment by financing and bank transfer, based respectively on the necessary conclusion of the financing contract between you and the finance company and the visibility of payment by bank transfer.

Shipping Costs

At GlamLuxe, we want to offer you a clear and unsurprising shopping experience. For this reason, we have simplified the rules regarding shipping costs:

1.      Free shipping on your first purchase and on all orders over €100 .

2.      For orders under €100 , a flat rate of €10 applies, regardless of your geographic location.

Shipping costs, if paid by the customer, will be clearly indicated during the Order Issuance Procedure and reported in the Order Summary email , in a specific section separate from the product price.

In some exceptional circumstances, couriers may apply a surcharge for particular conditions, such as:

1.      Limited traffic zones (ZTL);

2.      Locations that are difficult to reach or peripheral.

These additional costs, if applicable, will be communicated to you in a transparent manner before confirming the order. Payment of shipping costs, when due, will be made by accepting the Order Issuance Procedure .

No additional commission will ever be requested by GlamLuxe at the time of delivery or later. We guarantee maximum clarity and transparency in costs to offer you a reliable and hassle-free service.

Delivery Methods

GlamLuxe wishes to provide clear and transparent information regarding the delivery methods of the products purchased through our site. The following section concerns partial and differentiated deliveries, especially in the case where orders include products sold by different manufacturers or suppliers.

·         Partial Deliveries

If your order includes multiple products from different sources, it may be necessary to make partial deliveries. Partial deliveries allow us to ship the products that are available immediately, without waiting for all items to be ready for shipment. This approach allows us to reduce waiting times and ensure that the products are delivered as quickly as possible .

·         Differentiated Deliveries

Products from different suppliers may have different production or availability times. Therefore, deliveries may occur at different times for each product. GlamLuxe undertakes to promptly inform of any delays or variations in delivery times.

·         Acceptance of Partial and Differentiated Deliveries

By accepting our Terms and Conditions, the Customer acknowledges and accepts the possibility of receiving partial or differentiated deliveries. In the event of multiple deliveries, shipping costs will be calculated based on the total weight and volume of the items.

Communications and Traceability

To safely check the status of your shipment, you can visit the “Track Your Order” page using the tracking information to monitor the status of your deliveries.

Delivery by express courier

Deliveries are generally made at the following times and days: from 9.00 to 13.00; from 14.00 to 18.00, every day, except holidays, from Monday to Friday. This type of delivery includes delivery to the street front for all products purchased on Glamluxe by the contracted courier. Delivery is made by the courier without any type of telephone notice.

In the event of your absence, the courier will leave a notice of passage in your mailbox or at the custodian's and/or will retry delivery the next working day. In the event of further absence, the shipment intended for you will remain in storage in the courier's warehouses for a period of time varying between 3 and 10 days, awaiting instructions for release. If this attempt is also unsuccessful and/or the storage exceeds the aforementioned terms, the product will return to our suppliers' warehouses, with consequent cancellation of the Order and subsequent refund of the purchase price, according to the payment method chosen by you, with the exception of the cost of transport which remains at your expense. Should you have special requirements regarding delivery, you must communicate this to the email address ordini@glamluxe.it within 24 hours of the Order being issued and GlamLuxe will communicate this to the courier in charge, it being understood that it will be their choice to accept the request and in no way will it depend on GlamLuxe.

Upon delivery of the Product by the courier, please check:

·         That the number of packages delivered corresponds to that indicated on the delivery note or in the transport document (DDT);

·         That the packaging is intact, not damaged or, in any case, altered

·         If you notice any external damage or a discrepancy in the number of packages, you must immediately notify the courier making the delivery, by writing a specific reservation (for example but not limited to, you can write one of the following on the accompanying document: "collection with reservation for damaged package", "collection with reservation for open package", "collection with reservation for missing packages"). We would like to point out that GlamLuxe and/or the carrier do not take into consideration any generic reservations written on the accompanying document of the shipment.

Any hidden damage or anomalies of the Product and resulting from the transport of the Product must be reported to GlamLuxe Customer Care by opening an anomaly claim and confirming this condition, communicating the problem to the email address ordini@glamluxe.it , noting the item "I received a visibly damaged or tampered box" or "Some products I ordered are missing", remembering however that multiple purchases could result in multiple shipments.

Delivery Responsibility and Dispute Management

Pursuant to Art. 63 of the Consumer Code (Legislative Decree 206/2005) , the risk of loss or damage to the goods passes to the consumer only when the latter or a third party designated by him physically takes possession of the goods . Until that moment, the responsibility for shipping falls on GlamLuxe.

However, if the courier confirms the delivery through tracking tools and documentary evidence, the risk is transferred to the recipient.

1. Package lost before delivery

If the package is lost by the courier before delivery to the customer, GlamLuxe will:

  • Open a report with the courier to check the status of the shipment;
  • Refund the total amount of the order or make a new shipment at no additional cost to the customer;
  • Communicate the outcome of the check within the time frame set by the courier's investigations.

2. Package delivered but customer claims not to have received it

If the courier tracking indicates that the package has been delivered , but the customer declares that he has not received it, the following procedures apply:

  • The customer must check at his/her own address, with neighbours or with any third parties delegated to collect the goods (e.g. concierge);
  • GlamLuxe may request proof of delivery from the courier, which may include:
    • Signature of the recipient or a third party delegate;
    • Delivery photograph (if available);
    • GPS location recorded upon delivery.

If the courier provides valid proof of delivery , the refund or new shipment will not be guaranteed , unless further investigations are carried out. In these cases, the customer can proceed with a direct report to the courier.

3. Package delivered to the wrong address due to courier error

If the courier has delivered the package to an address other than the one indicated in the order, GlamLuxe undertakes to start a dispute with the courier to verify the error. If it is confirmed that the delivery was made to an incorrect recipient, the customer can choose between:

  • Free return of the product;
  • Full refund of your order.

If the courier does not provide clear evidence of an error in delivery, the claim will be evaluated on a case-by-case basis.

4. Customer's verification obligation and responsibility

To reduce the risk of disputes, the customer is required to sign the delivery receipt clearly and legibly , reporting the name and surname exactly as indicated in the order. In the event of disputes, the signature is a fundamental element for verifying the actual delivery.

If the customer refuses the delivery without a valid reason or does not provide useful information to clarify the problem, the refund request may be refused, unless the refusal falls within the exercise of the right of withdrawal pursuant to the Consumer Code or the right to renounce the purchase , if applicable according to current regulations. Once GlamLuxe receives the refused package, the refund will be processed according to the terms provided, provided that the package is unopened and never accepted by the customer.

5. Consequences of false or fraudulent statements

GlamLuxe reserves the right to report to the competent authorities any false or fraudulent declarations relating to the non-receipt of a package, when the courier has provided certain proof of delivery.

According to Art. 646 of the Criminal Code (Embezzlement) , anyone who embezzles property belonging to another may be prosecuted. In addition, Art. 495 of the Criminal Code (False Declaration to a Public Official) provides for sanctions for anyone who provides false information with the aim of obtaining an unfair economic advantage.

Although GlamLuxe operates with the utmost availability towards customers, any fraudulent behavior aimed at obtaining an unjustified refund or a product for free will be prosecuted according to current regulations.

Guarantees

All Products (hereinafter also referred to as “goods” or “goods”) sold by GlamLuxe to a “consumer” purchaser are covered by the legal guarantee on consumer goods, which covers defects of conformity that become apparent within 24 months of the date of delivery of the goods, as provided for by articles 128 et seq. of the Consumer Code (Legislative Decree 206/2005, updated) and, for anything not expressly provided for therein, by articles 1490 et seq. of the Civil Code on the sales contract. In accordance with article 132, paragraph 2 of the Consumer Code, the consumer is required to report the defect to the seller within two months of its discovery, under penalty of forfeiture of the right to the guarantee. The consumer's right to assert the legal guarantee expires twenty-six months after delivery of the product, as established by article 132, paragraph 1 of the Consumer Code.

To be considered compliant with the sales contract, the good must possess the following requirements, pursuant to Article 129 of the Consumer Code:

1) subjective requirements : a) correspond to the contractual description, type, quantity and quality and possess the functionality, compatibility, interoperability and other characteristics as provided for in the sales contract; b) be suitable for any particular use desired by you and which you have brought to the attention of GlamLuxe at the latest at the time of conclusion of the sales contract and which GlamLuxe has accepted; c) be supplied together with all the accessories, instructions, including those relating to installation, provided for in the sales contract.

2) objective requirements : a) be suitable for the purposes for which goods of the same type are normally used; b) be delivered together with the accessories, including packaging, installation instructions or other instructions, that you can reasonably expect to receive; and, c) be of the quantity and possess the qualities and other characteristics, including in terms of durability, functionality, compatibility and safety, ordinarily present in goods of the same type and that you can reasonably expect, taking into account the nature of the goods and public statements made by or on behalf of GlamLuxe, or by other persons in the context of previous steps in the chain of commercial transactions, including the manufacturer, in particular in advertising or on the label.

Pursuant to art. 135 bis, ter and quater of the Consumer Code, in the event of a lack of conformity, you have the right to:

·         Replacement of the goods without any costs to you

·         Within a reasonable period of time from the moment in which GlamLuxe was informed by you of the lack of conformity;

·         Without significant inconvenience to you, taking into account the nature of the good and the purpose for which you wanted the good.

If the lack of conformity must be remedied by replacing the goods, you must make them available to GlamLuxe and GlamLuxe will take back the replaced goods at its own expense. You are not required to pay for the normal use of the replaced goods in the period prior to the replacement.

In order to make the after-sales service of a high level and absolutely transparent, GlamLuxe undertakes, on a voluntary basis, to replace the defective product within a maximum period of 40 (forty) days from the request for assistance under warranty.

Price reduction and termination of the contract

a) if GlamLuxe has not carried out the repair or replacement or has not carried out the repair or replacement, where possible, pursuant to Article 135-ter, paragraphs 1, 2 and 3, or has refused to bring the goods into conformity pursuant to paragraph 3;

b) if a lack of conformity occurs despite the seller's attempt to restore the conformity of the goods;

c) if the lack of conformity is so serious as to justify the immediate reduction of the price or the termination of the sales contract;

d) if GlamLuxe has stated or it clearly results from the circumstances, that it will not proceed to restore the conformity of the goods within a reasonable period or without significant inconvenience for you.

You do not have the right to terminate the contract if the lack of conformity is only minor. The price reduction is proportional to the decrease in value of the goods you received compared to the value they would have had if they had been compliant;

a) You can exercise the right to terminate the sales contract by means of a declaration directed to GlamLuxe containing the expression of your will to terminate the sales contract;

b) If the lack of conformity concerns only some of the goods delivered and there is a cause for termination of the sales contract, you can terminate the contract limited to the non-compliant goods and those purchased together with the non-compliant goods, if it is not reasonably presumed that you have an interest in maintaining the goods not affected by defects at your disposal.

If you terminate the sales contract entirely or only some of the goods delivered under the sales contract: a) you must return the goods to GlamLuxe, at the latter's expense, and b) GlamLuxe will refund you the price paid for the goods upon receipt of the goods or of the evidence provided by you in relation to the fact of having returned or shipped the goods.

Cases of exclusion of the Legal Guarantee

In accordance with the provisions of the Consumer Code and the applicable Civil Code, the legal guarantee is excluded if one of the following hypotheses occurs:

·         The alleged defect is due (in whole or in part) to bad and/or improper use/storage/maintenance – attributable to you or attributable to persons not authorised by the manufacturer or by GlamLuxe – or is due to failure to comply with the instructions provided by the manufacturer and present for example in the product user manual or other instructions provided by GlamLuxe together with the products delivered.

·         The product has been delivered for technical examination to persons not authorised by the manufacturer or by GlamLuxe (e.g. technical assistance centres not authorised by the manufacturer)

·         The alleged lack of conformity of the Product has manifested itself after the term of 24 months from the delivery of the product itself.

·         At the time of conclusion of the contract, you were aware of the defect and expressly accepted it.

In particular, we would like to highlight and specify the concept of " improper use" of the jewels of the GlamLuxe collections which, like any goods in plated metal, require particular attention to maintain them in accordance with expectations:

·         Contact with chemicals: Avoid wearing plated jewelry when you are using chemicals such as detergents, perfumes or lotions. Chemicals can damage the plating, just as the acidity of sweat on your skin can.

·         Contact with water: Remove plated jewelry before bathing, swimming or washing hands. Water may cause corrosion or fading of the plating.

·         Friction and Scratches: Avoid wearing plated jewelry during activities that may cause scratches or friction, such as manual labor or exercise.

·         Contact with other jewelry: Avoid wearing plated jewelry at the same time or adjacent to other jewelry that is plated or made of other materials. Rubbing with other solid metals will accelerate the wear of the plating.

·         Exposure to direct sunlight: Intense sunlight can fade the plating over time. Store your jewelry in a dark place when not wearing it after carefully wiping it with a soft cloth.

·         Improper Handling: Use gentleness when handling plated jewelry. Avoid bending or pulling plated jewelry with excessive force. The plating may peel off or become permanently damaged.

·         Skin Allergies: Some people may develop allergic reactions to plating. If you notice any irritation or redness on your skin, discontinue use and consult a doctor.

Reporting incomplete products or products with missing accessories

The customer is required to verify the completeness and conformity of the product received at the time of delivery. If the product has missing parts or accessories not included, the customer must report it within 14 days of receipt , as required by art. 132 of the Consumer Code (Legislative Decree 206/2005, updated).

If the customer does not make any report within the deadline, the product will be considered complete and compliant with the sales contract. Consequently:

  • The legal guarantee of conformity cannot be applied to disputes relating to the completeness of the product, as the customer has accepted the goods as compliant at the time of delivery.
  • The right of withdrawal cannot be exercised for the reason of the lack of accessories or manuals.
  • A return with this justification will be automatically rejected and the refund will not be granted.

Processing of personal data

GlamLuxe undertakes to ensure full compliance with the legislation in force regarding the protection of personal data, in accordance with Regulation (EU) 2016/679 (hereinafter “GDPR”) and the Privacy Code pursuant to Legislative Decree no. 196 of 30 June 2003, as amended by Legislative Decree no. 101/2018.

The personal data provided by you are collected and processed by GlamLuxe on computer media and, where necessary, in paper format, in order to:

1.      Fulfill contractual obligations arising from the purchase of our Products.

2.      Manage the services you request , such as creating an account, processing orders and shipments, and sending promotional communications where authorized.

To ensure maximum security and protection of your personal data, GlamLuxe uses technological platforms offered by qualified third-party suppliers (for example, hosting services, e-commerce, email marketing) that strictly comply with European and international regulations on the protection of personal data. These suppliers guarantee the security of the databases and the integrity of the data through:

·         Advanced encryption systems;

·         Internationally recognized certifications, such as ISO 27001 for information security;

·         Compliance with GDPR requirements.

Rights of interested parties

Under Articles 15-22 of the GDPR , you have the right to:

1.      Access your personal data and receive a copy of it.

2.      Request rectification or erasure of data, where applicable.

3.      Limit or object to the processing of your data.

4.      Request data portability to another Data Controller.

5.      Submit a complaint to the Data Protection Authority if you believe that your rights have been violated.

To exercise your rights, you can send a written request to privacy@glamluxe.it . Requests will be processed within 30 days of receipt, except in cases of particular complexity, which will be promptly communicated to you.

Data storage and security

Your personal data will be stored for the time necessary to achieve the purposes indicated above and, in any case, no longer than the terms established by law.
GlamLuxe, through its third-party suppliers, adopts adequate technical and organizational measures to prevent unauthorized access, alterations, accidental losses and unauthorized processing of data.

Complaints

GlamLuxe is committed to ensuring maximum customer satisfaction by offering high quality products and services. However, if the Customer encounters problems relating to orders, products received or any other aspect of the service, he has the right to submit a formal complaint .

Complaints must be sent via:

For faster and more effective management of the report, the Customer is invited to indicate the order number , a detailed description of the problem and, where possible, attach supporting documentation (e.g. photo of the defective product, payment receipt, etc.).

GlamLuxe undertakes to respond to complaints in the shortest time possible , compatible with the complexity of the request, providing an adequate solution in compliance with current legislation on consumer protection.

Jurisdiction and Applicable Law

The contractual relationships between the Customer and GlamLuxe are governed exclusively by Italian Law , in compliance with the Consumer Code (Legislative Decree 206/2005) and Legislative Decree 70/2003 on Electronic Commerce .

In the event of civil or criminal disputes arising from the conclusion or execution of this distance selling contract, the territorial jurisdiction will be exclusively that of the Court of Milan , except as provided for by art. 66-bis of the Consumer Code , which guarantees the consumer the possibility of appealing to the court of his/her place of residence or domicile, if located in Italy.

GlamLuxe also informs that, pursuant to EU Regulation 524/2013 , consumers residing in the European Union have the possibility of resolving any disputes out of court through the ODR (Online Dispute Resolution) platform , accessible at the following link: https://ec.europa.eu/consumers/odr .
